Risk Assessments – A Saving Grace
What was supposed to be a fun treat at a birthday party turned into a nightmare when the bouncy castle that was rented for the day went flying into the air, kids inside and landed on a roof some distance away. The castle was not anchored properly and got picked up by high winds. At another party an inflatable device was overloaded with children and collapsed, spilling the kids out onto the concrete sidewalk. In both cases inexcusable negligence was responsible for accidents that caused injuries to children. Both cases could have been prevented had the organizations undergone a risk assessment prior to renting these devices. What is involved in a risk assessment? Case Overview – Giuliani v. Region of Halton: Application for Leave to Appeal to the Supreme Court of Canada
This session will provide a detailed review of the decision by the Court of Appeal for Ontario, its effect upon the defences available under sections 4 and 5 of the MMS, and the arguments which have been submitted to the Supreme Court of Canada, in support of obtaining permission to appeal the Court of Appeal’s decision, which many believe has effectively rendered these sections of the MMS meaningless. Charles was counsel who assisted in presenting the Appeal in the Giuliani case to the Court of Appeal for Ontario, and in preparing the Application for Leave to Appeal to the Supreme Court. Following the presentation, Charles will be happy to answer questions, and provide his views on this important development in the law respecting municipal liability for highway maintenance.

As the Corporate Insurance & Risk Manager, Linda provides insurance and risk management consulting services for public entities including municipalities, educational and healthcare institutions, large manufacturers, financial institutions and other clients with diverse and global operations. Linda has taught insurance courses at Mohawk College through the Insurance Brokers Association of Ontario and currently teaches the Risk Management Diploma courses at McMaster University in Hamilton, Ontario. Complying with Reporting Requirements, The Blue Mountain Case & Ophea Concussion Response Protocol
Part I - A recent decision (Blue Mountain Resorts Limited v. Ontario (Labour)) of the Divisional Court confirms that employers and contractors are required to report a critical injury or fatality suffered by a non-worker in the “workplace” to the Ministry of Labour, regardless of whether workers were present at the time of the occurrence. This decision has raised several questions, including what is the definition of a Workplace? What is a Critical Injury? When and how do we report these workplace incidents? This presentation will help to answer these questions, while better explaining how this decision was determined and what the implications are for Employers.
Part II - In a Press Release dated March 6, 2012, the Ontario Provincial Government introduced legislation to address concussions occurring both inside and outside the classroom.
The legislation, known as the Education Amendment Act (Concussions), 2012 is a three point strategy that, when implemented, will:
- provide resources to parents, teachers and school staff about the seriousness of
concussions;
- build awareness beyond schools about the dangers of concussions and how they
should be managed; and
- establish a committee to provide advice on concussion prevention, identification
and management in schools.
This legislation would require school boards to develop policies and guidelines regarding concussions, distribute material and educate staff.

The Power of Humour & Laughter
In most cultures, including North America, humour and laughter are perceived as trivial side-effects of being human - fun but hardly essential. Everyone proclaims the importance of a "sense of humour", but few of us live as though we believe it. As you can tell from the title, I believe humour and laughter are actually necessities of life, essential for wellbeing, health, and even job-performance, and there is a large and growing base of scientific research to back me up. That's right! Research on humour, involving real behavioural scientists, is ongoing in respected universities worldwide. And although Psychology leads the way, there's plenty of evidence coming out of other disciplines as well.
