Claims & Human Rights Codes

Christopher J. Edwards - Templeman Menninga LLP Barristers

                                                and Solicitors

The Ontario Human Rights Code has undergone important legislative changes in the past several years that have had a significant impact on insurers and their clients.  Since the Human Rights Commission lost its "gatekeeper" role, the Human Rights Tribunal is now hearing more complaints and the monetary awards granted to successful complainants will continue to increase. In this presentation you will hear about the following:

* The Recent Changes to the Human Rights Code

* An overview of the new processes and procedures

* Trends in damage awards

* Coverage challenges based on conventional policies of

   insurance based on actual proceedings

* Risk avoidance strategies

Leading the presentation will be Christopher J. Edwards from Templeman Menninga LLP.  Christopher is a seasoned management-side labour, employment and human rights lawyer who provides services to many public sector employers, including municipalities, school boards and not-for-profit organizations throughout Ontario.  He is also regularly retained by insurers to defend claims on behalf of insureds that involve human rights and labour/employment related issues.

10:45 a.m. - 11:00 a.m.        Coffee Break/Networking

11:00 a.m. – 12:30 p.m.                 Workshop Speaker

Canada's Weather - The Climate That Shapes A Nation

Chris St Clair - The Weather Network

Chris’s presentation begins with our place on Earth, and how this offers us the most extreme weather of all types of any nation on the planet. It will detail some of the major weather events we have faced in the past 50 years, such as The Ice Storm, Hazel, Juan, White Juan, the Winnipeg Floods and the Kelowna Fires.

Throughout his presentation, Chris will offer that through climate change and the present acceleration of global warming, we are going to witness an increase in the unpredictability and magnitude of similar weather events, and this will occur on a much more frequent widespread scale in the coming years. Naturally, this will provide Risk Managers with some valued insight for what to expect and how it may affect their place of business.

There are solutions to the problems we face; as Canadians we have learned to respect nature and plan accordingly for our environment, as this environment changes, we should become world leaders in planning for future weather and climate impacts.

This presentation will be very informative as it’s been said, “weather is the fire” when dealing with claims.
