Description: A contract can allocate risk on paper, but it cannot transfer risk to a fictitious, uninsured or assetless counterparty. A public entity may retain statutory duties and become the only solvent defendant when something goes wrong. Loopstra Nixon will walk us through fictitious vendors, vendors that misrepresent or fabricate their qualifications, and vendors that lack required insurance coverage. This will include the legal and liability risks these situations create for public entities. They will also explore practical steps public entities can take to protect themselves, including appropriate due diligence and verification measures.
